Rulemaking Activity
The Cannabis Control Division’s proposed rules are available for public review.
Proposal Notice: MAR Notice No. 42-1072 – pertaining to implementation of House Bills 128, 903, and 948 (2023), and revising requirements applicable to chemical, infused product, and mechanical manufacturers of marijuana. Public Hearing will be held on January 18, 2024.
Proposal Notice: MAR Notice No. 42-1073 – pertaining to packaging and labeling of marijuana; marijuana wholesaling; and marijuana advertising. Public Hearing will be held on January 19, 2024
The public comment deadline is January 22nd, 2024.
Building and Fire Inspection Not Required for Marijuana Storage Facility
Effective immediately: fire and building inspection documents are no longer required to be uploaded in the TransAction Portal for a Marijuana Storage Facility License application.
500 Feet Distance Changes Starting January 1, 2024
Effective 01/01/2024: the department shall deny any cultivator, manufacturer, or dispensary license if the proposed licensed premises is within 500 feet of a child-care facility licensed or registered by the Montana Department of Public Health & Human Services (DPHHS).
This provision applies to new license applications submitted on or after effective date of this section. Per MCA 16-12-207 (3)(a)(iii)).
Synthetic Marijuana Advisory Council
The Synthetic Marijuana Advisory Council had their first meeting on November 30, 2023. Their next meeting is scheduled for January 4, 2024.
This council was created from House Bill 948,. The first meeting was recorded and is available to watch at the link below:
Avoiding Common Metrc Errors
As a licensed business, you can avoid these common Metrc mistakes. The guide below has been created to address the common issues/errors that businesses are currently making with respect to their Metrc account.
Addressing these issues in a proactive manner can assist with time, effort, and finances for businesses with respect to these errors.
Updated Worker Permit Trainings
The worker permit trainings have been updated and are available on Moodle. Both certificates are required for new worker permit applications and renewals. You must provide both certificates to your employer as well.
